According to the appeal, the issue remained unresolved despite обращения to the Public Services Center and the district department of the Cadastre Agency, which prompted the applicant to seek practical assistance in restoring his lawful rights.
It was established that in 1984, residential premises, which had been on the balance sheet of a collective farm, were allocated for residence to the applicant’s late father. However, due to an error in the spelling of his surname in the supporting documents, complications arose in the process of formalizing inheritance rights.
The appeal was taken under the Ombudsman’s supervision, and, in the interests of the citizen, an application was filed with the court to establish a legally significant fact.
The inter-district administrative court of the Jizzakh region, having examined the case materials, established the legally significant fact that the residential premises had indeed been allocated to the deceased citizen and satisfied the application.
This court decision removed the obstacles to formalizing the inheritance and created a legal basis for the heirs to exercise their lawful rights.
