Labour Rights of a Woman Subjected to Gender Discrimination Restored
A citizen, A.Yu., appealed to the Commissioner of the Oliy Majlis of the Republic of Uzbekistan for Human Rights (Ombudsman), reporting that she had been subjected to gender discrimination during the recruitment process.

According to the appeal, in January 2026 she underwent an interview for a vacant position in one of the organizations in the economic sector in the region of Tashkent, submitted an application, and signed an electronic employment contract. Following this, the issuance of an employment order was expected.

However, she was later refused on the grounds that women were not being hired for the position. According to the applicant, this decision was based not on her professional qualifications or work experience, but solely on her gender.

This situation contradicts Article 58 of the Constitution of the Republic of Uzbekistan, which guarantees equal rights for women and men, Article 42, which ensures the right to work without discrimination, as well as Article 4 of the Labour Code.

The case was taken under the Ombudsman’s supervision and examined with the participation of the Ombudsman’s regional representative in Tashkent region, as well as officials of the State Labour Inspectorate of Tashkent region.

As a result of the review, the applicant’s labour rights were restored, and she was employed in the respective position.

Such an approach contradicts not only the requirements of the law but also the principles of fairness and equal opportunities in labour relations. Every employer must assess a candidate not based on gender, but on professional qualifications, knowledge, and potential.
