According to the appeal, the employee, who had been working at a family polyclinic, was transferred to another family polyclinic while on childcare leave. However, the transfer was not formalised in accordance with the procedure established by labour legislation.
The appeal was taken under the supervision of the Ombudsman’s Regional Representative in the Samarkand Region, who obtained the relevant documents and explanations from the Qushrabot District Health Department.
Following the review, the Ombudsman submitted a formal representation to the Samarkand Regional Health Department, calling for the violation of the law to be remedied and the causes and conditions that had contributed to it to be addressed.
Following the Ombudsman’s formal representation, the Qushrabot District Health Department issued the relevant order, enabling citizen M.M. to return to work before the end of her childcare leave, at her own request.
In addition, reduced working hours of no more than 35 hours per week were established for the employee until her child reaches the age of three.
