The case was taken under supervision by the Ombudsman’s regional representative in Fergana region. Upon examination of the relevant materials, it was established that the grounds cited for dismissal did not fully comply with the requirements of Article 168, Part 1, Clause 4 of the Labour Code of the Republic of Uzbekistan. In particular, it was not taken into account that the applicant had been continuously employed since 2017, and no additional qualification requirements had been introduced for his position during that period.
Legal support was provided in filing a claim with the court regarding reinstatement, recovery of wages for the period of forced absence, and compensation for moral damages. According to the decision of the Fergana Interdistrict Civil Court, the citizen was reinstated to the position of educator, and UZS 16,300,000 in wages for the period of forced absence, as well as UZS 5,000,000 in compensation for moral damages, were awarded in his favour.
The citizen has now resumed his employment.
