The draft law aims to improve existing legal mechanisms for ensuring the rights of persons held in pre-trial detention facilities, to more effectively implement constitutional guarantees in practice, and to align national legislation with advanced international standards.
In preparing the draft, the Ombudsman’s institution studied monitoring visit findings and prisoners’ appeals and analyzed current procedures. Accordingly, provisions were proposed to review certain practices in remand centers and bring them into conformity with international human rights benchmarks.
When drafting the bill, the experience of a number of countries—including the United States, Sweden, Norway, Finland, Germany, Canada, the United Kingdom, Russia, and Kazakhstan—was examined.
