After examining the relevant employment documents, a lawsuit was filed in court in the citizen’s interests. The court confirmed the fact of his employment under harmful conditions. However, the responsible official again refused to assign the pension, citing that the employer had failed to pay insurance contributions.
Deficiencies in the employer’s financial accounting cannot limit the employee’s right to a pension. Therefore, a second lawsuit was filed to declare the decision of the relevant authority unlawful.
The court found the decision of the Pension Fund illegal and ordered the Fund to assign the pension to the citizen.
Thus, citizen Y.A.’s right to a preferential pension for his long-term work was restored.
