Former employee who was on parental leave reinstated at work, 1.5 million soums of moral damages recovered from employer – Ombudsman
A resident of the Okhangaron district of the Tashkent region M.Sh. applied to the Authorized Person of the Oliy Majlis for Human Rights (Ombudsman) with an appeal about illegal dismissal by the employer, despite the fact that she was on parental leave.

The appeal was taken under the control of the Ombudsman and as a result of its study it turned out that the applicant is currently pregnant, and the employment contract concluded with her by the employer on July 21 this year was terminated in accordance with Article 105 of the Labor Code.

This appeal was studied on the spot by the regional representative of the Ombudsman in the Tashkent region with the participation of citizen M.Sh., the necessary information was received.

After that, in August of this year, the Authorized Person of the Oliy Majlis for Human Rights (Ombudsman) filed a claim with the Okhangaran Interdistrict Court for Civil Cases in the interests of citizen M.Sh. on the issue of reinstatement.

 During the trial, the Ombudsman filed an additional claim for the recovery of moral damage caused to the citizen.

The application of the Ombudsman in the interests of the citizen was satisfied by the Okhangaran Interdistrict Court for Civil Cases.

By a court decision of 04.10.2022, a decision was made to reinstate citizen M.Sh. in office and recovering 1.5 million soums from the employer for the moral harm caused to her.
